In a significant ruling, the District Consumer Disputes Redressal Commission (DCDRC) in Ahmedabad has directed Ola Electric to fully refund the cost of a defective S1 X Plus electric scooter to a consumer. The commission also mandated additional compensation for mental agony and legal expenses, citing repeated breakdowns and a clear deficiency in the company's after-sales service.
Consumer Complaint Details Ola Electric's Service Failures
The complaint was filed by Ahmedabad residents Swati M. Makhija, Manohar Makhija, and Nitin Makhija under Section 35 of the Consumer Protection Act, 2019. After purchasing an Ola S1 X Plus in January 2024 for ₹1,02,687 (including registration and road tax), the family experienced issues just two days after delivery.
On January 27, 2024, an unusual rear sound was reported. The service center responded by abrading the brake pads by 30 percent instead of replacing them. Further issues arose on February 25, when the scooter's digital system abruptly shut down while being ridden near the airport, leaving the riders stranded.
DCDRC Orders Full Refund and Compensation
After reviewing the evidence, including service records, the DCDRC bench, comprising In-charge President MH Patel and In-charge Members Dr SR Pandya and BJ Acharya, severely criticized Ola Electric's after-sales service. The commission concluded that the company failed to effectively address the consumer's grievances, constituting a deficiency in service under consumer protection laws.
The ruling mandates Ola Electric to refund ₹1,05,729, along with 9% annual interest from the date of purchase. Additionally, the company must pay ₹40,000 as compensation for mental agony and ₹10,000 towards litigation expenses. Ola Electric has been given 30 days from the judgment date to comply with these orders.
Wider Implications for Ola Electric
This Ahmedabad judgment is not an isolated incident. Ola Electric has faced a series of consumer disputes across India in recent months. Consumer commissions in cities like Thane, Dharwad, Visakhapatnam, and Bengaluru have issued similar rulings against the company, addressing cases involving defective scooters, warranty disputes, and alleged service deficiencies. This trend highlights a growing scrutiny of the electric vehicle manufacturer's product quality and customer support.
