OpenAI Accuses Former Employee, Now at Apple, of Stealing Unreleased Product Files

· · 2 min read

OpenAI has accused a former employee, now working for Apple, of stealing over 100 confidential files related to an unreleased product. The alleged data theft has escalated a legal dispute between the tech giants, with a trial tentatively set for 2027.

A high-stakes legal battle is intensifying between artificial intelligence pioneer OpenAI and tech giant Apple. OpenAI has formally accused a former employee, who subsequently joined Apple, of illicitly taking over 100 confidential files pertaining to an unreleased product.

According to court filings in a US federal court in San Jose, California, OpenAI alleges that the employee transferred these sensitive documents to a personal account. The AI firm expressed significant concern that its proprietary trade secrets and confidential information are now circulating within Apple, potentially influencing the development of Apple’s upcoming products.

Allegations of Data Transfer and Product Influence

OpenAI's filing points to the employee allegedly sharing more than 100 files about a secret project. The company highlighted that a presentation involving these stolen details reportedly took place months ago. OpenAI cited Apple's recently launched 'HomeView' product as an example of Apple's growing interest in developing its own AI offerings, suggesting a potential link to the allegedly pilfered information.

The AI firm further stated that it identified two personal phone numbers that purportedly received files related to the unreleased product. However, Apple's legal team has countered, arguing that these numbers do not align with the employee's work contact information at Apple.

Apple Denies Claims, Vows Cooperation

Apple has vehemently denied OpenAI's allegations, stating that its internal investigations have found no evidence to support the claims of trade secret theft. The iPhone maker emphasized its stringent company rules and procedures designed to prevent employees from bringing confidential information or trade secrets from previous workplaces.

Despite the denial, Apple has committed to cooperating with OpenAI to further investigate the serious allegations. This particular case adds another layer to existing legal tensions, as Apple itself has similar allegations against a former employee now working at OpenAI, accused of stealing trade secrets from Apple.

Upcoming Trial and Industry Impact

The legal dispute is tentatively scheduled for trial in October 2027, though OpenAI has indicated in court filings that it could be prepared to proceed as early as June 2027. This case underscores the intense competition and increasing concerns over intellectual property and trade secret protection within the rapidly evolving technology sector, especially in the burgeoning field of artificial intelligence.

“OpenAI is very concerned that its trade secret and confidential information is now circulating inside Apple, where Apple engineers can shape Apple’s upcoming products based on OpenAI’s confidential and innovative work,” OpenAI stated in its filing.
