India Empowers Government to Cap Sky-High Airfares Amid Market Spikes

· · 2 min read

New regulations, effective January 1, 2027, grant the Indian central government power to intervene and cap airline tariffs during extraordinary market spikes. Airlines must also provide clear, itemized fare breakdowns to passengers.

New airfare provisions set to take effect on January 1, 2027, will empower the Indian central government to intervene and cap airline tariffs during periods of significant market disturbance. These regulations, introduced under Rule 192 of the Bharatiya Vayuyan Niyam, 2026, aim to protect consumers from exorbitant pricing in exceptional circumstances, while generally maintaining a deregulated, market-driven fare structure.

While the Directorate General of Civil Aviation (DGCA) is primarily responsible for monitoring airline tariffs, sub-rule (6) explicitly grants the central government the authority to step in. This intervention power will be exercised only when an "extraordinary situation" arises, allowing the Centre to issue written directions deemed necessary and expedient in the public interest. Any such intervention will be proportionate to the circumstances and remain in force only for a specified period.

Enhanced Transparency for Air Passengers

A key aspect of the new rules emphasizes greater transparency for passengers. Airlines operating under the specified rules are now required to establish their tariffs based on operational costs and submit these structures to the DGCA. Furthermore, these established tariffs must be publicly accessible on the airlines' official websites or designated digital platforms, ensuring wider public awareness.

Passenger disclosures are also significantly strengthened. The tariff displayed on booking websites and issued tickets must clearly state the total amount payable, accompanied by a complete itemized breakdown. This detailed breakdown must separately list:

  • Base fare
  • Taxes (amounts payable to the government)
  • Fees (amounts payable to service providers for facilities)
  • Cancellation charges
  • Refund conditions
  • Any additional charges

This comprehensive approach aims to provide consumers with a clear understanding of all components contributing to their total airfare, fostering a more transparent and fair booking experience.
