A Special MP/MLA court in Sultanpur, Uttar Pradesh, has recently dismissed a 2018 defamation case filed against prominent Congress leader and Lok Sabha Leader of Opposition, Rahul Gandhi. The case stemmed from remarks Gandhi allegedly made about then-BJP national president Amit Shah during a press conference in Bengaluru.
Origins of the Defamation Complaint
The defamation complaint was lodged in May 2018 by Vijay Mishra, who at the time served as the BJP district vice-president and chairman of the local District Co-operative Bank. According to Mishra's counsel, Advocate Kashi Prasad Shukla, Gandhi was accused of making “objectionable remarks” about Amit Shah, specifically referring to him as an “accused in a murder case.”
Gandhi had traveled from Delhi to Sultanpur to be present in court for the pronouncement of the verdict. He had previously been summoned by the MP/MLA court on December 16, 2023, in connection with the ongoing legal proceedings.
Complainant's Expectations and Legal Context
Prior to the verdict, complainant Vijay Mishra had expressed optimism, telling ANI that he was “hopeful” of receiving justice from the court. He emphasized that the legal battle had been ongoing since 2018, leading up to the recent decision.
Legal experts had noted that if found guilty, Section 500 of the Indian Penal Code (IPC) allows for a potential sentence of two years of imprisonment and a fine. Additionally, under Section 437A of the Criminal Procedure Code (CrPC), an accused is typically required to execute bail bonds to ensure appearance before higher appellate courts should an appeal be pursued against the trial court’s judgment.
Court's Decision
The Sultanpur court’s decision to dismiss the Rahul Gandhi defamation case marks the conclusion of a significant legal challenge that had been active for several years, drawing considerable attention in political circles.
